The Maui County Council voted 5-4 on Friday to settle a Clean Water Act lawsuit headed to the U.S. Supreme Court. But a last-minute revelation from county attorneys has set up a showdown between councilmembers and Mayor Michael Victorino.

A federal court ruled Valley Isle wastewater treatment plants violate the Clean Water Act. The island’s mayor wants to challenge the ruling at the Supreme Court, but lawmakers want to settle. A decision may come down to a Maui County Council vote today.

WAILUKU, Hawaii — Maui Mayor Michael Victorino on Sunday criticized a decision by a County Council comnittee to recommend acceptance of a settlement proposal with environmental groups that sued over the use of injection wells.

Update, 5:30 PM, May 23rd, 2019: The GET Committee deferred the resolution with a 4-4 split. The resolution will remain in the committee, and will be discussed at a later time.

Members of the Maui County Council on Monday considered a settlement offer in the case of a county wastewater facility. The case is currently scheduled to be heard by the U.S. Supreme Court.
