The Maui County Council voted 5-4 on Friday to settle a Clean Water Act lawsuit headed to the U.S. Supreme Court. But a last-minute revelation from county attorneys has set up a showdown between councilmembers and Mayor Michael Victorino.

WAILUKU, Hawaii — Maui Mayor Michael Victorino on Sunday criticized a decision by a County Council comnittee to recommend acceptance of a settlement proposal with environmental groups that sued over the use of injection wells.

The Sierra Club and Surfrider Foundation delivered two petitions to Maui County Council Chair Kelly King Wednesday, urging councilmembers to settle the county's legal case involving its Lahaina wastewater treatment facility, and withdraw its appeal to the U.S. Supreme Court.

Members of the Maui County Council on Monday considered a settlement offer in the case of a county wastewater facility. The case is currently scheduled to be heard by the U.S. Supreme Court.
